Whenever the Director of Public Service finds that, by reason of making a diversion, culvert, enclosure, fill or partial fill thereon, a tract of land is inadequately drained or that such diversion, culvert, enclosure, fill or partial fill obstructs or interferes with lawfully existing sewerage or drainage he shall notify the person owning or having the possession, charge or management of such lot or parcel of real estate to remove the fill or to provide the necessary sewerage to adequately serve the drainage area. The notice may be served upon such person by personal delivery, by mail at his last known place of residence or by posting it on the premises. Failure, after service of the notice, to remove the fill or to provide the necessary sewerage shall constitute an unlawful act if continued for a period of ten days. Each additional period of ten days thereafter during which the owner fails to carry out the order of the Director shall constitute a separate offense.
