(a) No person shall knowingly obtain or exert control over recyclable waste items placed into recycling bins which are located in either the public right of way for waste collection purposes consistent with the Norwood Codified Ordinances or on the private property of another, if done in one of the following ways:
(1) Without the consent of the owner or person whose recycling bin contains the recyclable waste items;
(2) Beyond the scope of the express or implied consent of the owner or person whose recycling bin contains the recyclable waste items;
(3) By deception;
(4) By threat;
(5) By intimidation.
(b) Whoever violates this section is guilty of theft of recyclable waste items, a misdemeanor of the first degree.
