541.10 BILL POSTING, SIGNBOARDS, SIGNS RESTRICTED.
   (a)   Public Property. No person shall construct upon any fence or wall any board used for the purpose of bill posting and no person shall paste, post, print, nail or otherwise fasten any sign, poster or advertisement, or notice of any kind whatsoever, or cause the same to be done on any curbstone, flagstone or any other portion or part of any sidewalk, telegraph pole, telephone pole, hydrant, bridge or any other structure within, in the lines of any of the streets of the City, except such as may be required by the City ordinances duly authorized by law.
   (b)   Private Property; Display of Owner's Consent, Permit. No person shall paste, post, print, paint, nail or otherwise fasten any sign, poster, advertisement or notices of any kind, or cause the same to be done upon any private wall, window, door, gate, fence, advertising board or sign, or upon any private structure or building of any kind, unless he is the owner thereof, without the consent in writing of the owner of such wall, window, fence, gate, advertising board or sign, or other private building or structure, and whoever is found in the act of fastening any sign, poster or advertisement as aforesaid upon any private property shall, upon demand, produce the written consent as herein required together with a necessary permit of the City Auditor as hereinafter provided for.
   (c)   Permit Application. Before any owner of any premises upon which a person desires to paste, post, print, paint, nail or otherwise fasten any sign poster, advertisement or notice of any kind as aforesaid gives his written consent for the same, he shall first present in writing to the City Auditor an application for a permit describing substantially the nature and object of the sign, poster or advertisement, and no permission shall be granted by an owner to any person as aforesaid until a permit therefor has been secured from the City Auditor.
   (d)   Real Estate Sale Signs. Nothing in this section shall be deemed to restrict the placing upon private property of a painted signboard, advertising property for sale by the owner thereof, or any real estate or other agent, nor shall the provisions of this chapter be deemed to cover any advertisements now upon any private wall, window, door, gate, fence, advertising board or sign.
   (e)   Bench Signs and Benches. Bench signs and benches bearing advertising displays painted or otherwise affixed to their surfaces are permitted only in Industrial "A" Zones, and where so placed in an Industrial "A" Zone, must be placed at least thirty feet from the nearest road right of way.
   No person owning or in charge of a bench sign shall place or cause such bench sign to placed in a prohibited area.
   (f)   Misdemeanor Classification. Whoever violates this section is guilty of a minor misdemeanor.
