(a) Any parent, guardian or other adult person having the care and custody of a minor who violates Section 530.02 shall for the first offense be guilty of a minor misdemeanor; for a second or subsequent violation occurring within a twelve month period, such parent, guardian or other adult person shall be guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed for each violation under Section 530.02.
(b) Any parent, guardian or other adult person having the care, custody or supervision of a minor who fails or refuses to appear and take custody of such minor after a demand from a law enforcement officer, pursuant to Section 530.04, shall be guilty of a minor misdemeanor.
