527.03 WASTE DISPOSAL.
   (a)   Setting Out Containers. It shall be the duty of every owner, tenant, agent, lessee, occupant and person in charge of any and every building, premises or place of business in the City to place in properly closed regulation containers, all waste that is to be collected by the City's waste collection service. Such containers shall be placed not more than three feet from the curb or curb-line in front of any and every such building, premises or place of business no earlier than 5:00 p.m. or an hour before sunset, whichever is earlier on the day before the scheduled day of collection.
   (b)   Street Waste Receptacles. Waste receptacles of the City placed on the sidewalks and City streets shall be used only for such waste material as persons may have for disposal while passing along the streets. Such receptacles shall in no case be used for the disposal of trash, refuse or other waste material accumulated in residences or places of business.
   (c)   Waste Containers; Requirements.
      (1)   Containers for waste shall be of galvanized iron, steel or other nonrusting metal, or of heavy plastic, of substantial construction, with tight-fitting lids, water tight, of such size as to be easily handled by one person and not in any case to have a capacity in excess of twenty-seven gallons. Such lids shall be firmly seated upon the containers at the time they are set out for collection.
      (2)   Plastic bag liners may be used for the disposal of waste if they are of heavy duty quality such that they will not tear under the weight of their contents and securely fastened at the opening when placed at the curb for collection.
      (3)   Any waste set out for collection shall be secured in such a way as to prevent such waste from being carried away by wind or other elements or animals.
      (4)   Except during permissible periods of placement at the curb for weekly garbage collection, waste containers shall be stored in a location that is not visible from the public right of way.
   (d)   Waste Generated Off-Site. No person shall place for pickup by the City waste collection service any waste generated at a site other than the property abutting the curb at which such waste is set out.
   (e)   Personal Property Left or Abandoned on Streets and Sidewalks.
      (1)   Personal property shall not be abandoned or allowed to remain upon public streets or sidewalks by reason of eviction or otherwise. Such personal property shall be considered waste or litter if it is not immediately removed from the sidewalk and placed out of public view by its owner and further, shall be subject to collection and disposal by the City and/or enforcement of any other applicable provisions of this code.
      (2)   The City shall not assume any liability of any type for any personal property, either abandoned on the street or sidewalk, or disposed of as provided above.
   (f)   Nighttime Waste Collection. No person, association, firm or corporation shall, during the hours from 11:00 p.m. to 7:00 a.m., engage in or undertake any waste collection activity that produces loud noises so to disturb the peace and quiet of the neighborhood, having due regard for the proximity of places of residences, hospitals, or other residential institutions.
   (g)   Disposal of Uncollected Waste. It shall be the duty of every owner, tenant, agent, lessee, occupant and person in charge of any and every building, premises or place of business in the City whose waste is not placed at the point or points of collection in the scheduled date and time of collection, to dispose of the uncollected waste at the sole expense of such owner, tenant, agent, lessee, occupant and person in charge of any and every building, premises or place of business before the time of the next regular scheduled date and time of collection or the waste shall be placed at the point or points of collection by the next regularly scheduled date and time of collection.
   (h)   Containers to be Removed from Collection Points. It shall be the duty of every owner, tenant, agent, lessee, occupant and person in charge of any and every building or premises or place of business in the City to remove any and all waste containers from the points mentioned in subsection (a) hereof by midnight on the day on which the waste was collected.
   (i)   Dates of Collecting Waste. The Service Director shall be authorized to arrange date schedules for the public collection of waste in the various sections of the City.
   
   (j)   Area Around Dumpsters to be Kept Clean. The owner of land upon which any dumpster is situated shall be jointly and severally responsible, together with any tenant or other authorized user of the dumpster, for maintaining the area around the dumpster in a clean and litter-free condition at all times.
