509.09 CURFEW.
   (a)   No child under the age of eighteen years shall be outside the confines of his homesite and congregate, wander, loiter or play upon the streets and other public places of the City, between the hours of 11:00 p.m. and 5:00 a.m.
 
   (b)   No person having the control and custody of or being the parent or guardian of a minor shall knowingly permit such minor to be outside the confines of his homesite and to congregate, wander or loiter or play upon the streets and other public places of the City, in violation of subsection (a) hereof, unless such person accompanies such minor in public places.
 
   (c)   The provisions of subsection (a) hereof shall not apply to minor accompanied by a parent or guardian.
 
   (d)   The provisions of subsections (a) and (b) hereof shall not apply to minors engaged in lawful employment requiring them to be upon the streets and other public places of the City, during such prohibited hours in the proper discharge of their duties while so employed, nor shall the provisions of such subsections apply to minors returning directly home from events such as school, church, or civic sponsored activities.
 
   (e)   Any minor violating subsection (a) hereof shall be dealt with in accordance with Juvenile Court law and procedure.
 
   (f)   Whoever violates subsection (b) hereof is guilty of a minor misdemeanor on the first offense. A second or subsequent offense of subsection (b) shall be a misdemeanor of the fourth degree.
