375.09 OPERATION GENERALLY.
   (a)   No person shall operate a snowmobile or all purpose vehicle in such a manner as to cause dust, debris, dirt or stones to drift or be cast upon the lands of another.
   (b)   No person shall operate a snowmobile or all purpose vehicle unless the operator and passengers are wearing helmets approved by the Director of Highways of the State of Ohio for use on motorcycles on public highways.
   (c)   No person shall operate a snowmobile or all purpose vehicle unless the operator and the passengers are wearing enclosed shoes.
   (d)   No person shall operate a snowmobile or all purpose vehicle when such vehicle is occupied by more persons than it was designed for.
   (e)   No snowmobile or all purpose vehicle shall be operated unless the exhaust noise emission meets the minimal standards adopted by the FIM. (Ord. 73-39. Passed 6-5-73.)
   (f)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
