723.05 STANDARDS OF CONDUCT AND OPERATION.

   (a)   Standards for Exotic Dance Studios.

      (1)   Standards of conduct. The following standards of conduct shall be adhered to by patrons, entertainers and/or employees of exotic dance studios at all times adult entertainment is performed.

         A.   Admission to exotic dance studios under this section shall be restricted to persons of the age of eighteen ( 18) years or more.

         B.   All dancing and adult entertainment by an entertainer shall occur on the entertainment performance areas intended for that purpose as described in this chapter.

         C.   No dancing or adult entertainment shall occur closer than six (6) feet to any patron.

         D.   No patron or customer shall go into or upon the adult entertainment performance area described in this chapter while adult entertainment is being performed.

         E.   No employee or Entertainer shall be nude or shall entertain while nude.

         F.   No patron shall place any money in or upon the costume of any Entertainer.

         G.   No patron shall pay any tip or gratuity or any other form of monetary consideration directly to an Entertainer.

      (2)   Construction. The following construction standards shall be complied with by all exotic dance studios:

         A.   The permit premises shall be equipped with overhead lighting fixtures of sufficient intensity to illuminate the permit premises at an illumination of at least five footcandles as measured at floor level.

         B.   The area where adult entertainment is to be performed is to be on a raised platform which is at least twenty-four inches from the floor of the permit premises.

         C.   A sign containing the following information must be displayed on the permit premises in at least 48-point type:

            1.   That no loitering is permitted in the leased premises.

            2.   That sexual activity is not permitted on the premises.

            3.   That entertainers are not permitted to receive tips or gratuities.

            4.   That sexual activity can cause the transmission of the Human Immunodeficiency Virus (HIV) or sexually transmitted diseases.

            5.   That the permit premises is subject to periodic inspection by the City of Norwalk and/or the employees of the permit premises.

            6.   That persons under the age of 18 are not permitted in the permit premises.

            7.   That patrons may not place money in or upon the costume of an entertainer.

   (b)   Standards for Adult Arcades. All adult arcades shall comply with the following additional regulations:

      (1)   Construction/maintenance.

         A.   All wall surfaces, ceiling surfaces and seating surfaces in viewing booths shall be constructed of, or permanently covered by, nonporous easily cleanable material.

         B.   All floor coverings in viewing booths shall be nonporous, easily cleanable surfaces with no rugs or carpeting.

            No doors shall be permitted upon individual viewing booths.

         C.   No holes or openings of any kind shall be permitted to exist between viewing booths or in the wall of any viewing booth.

         D.   The manager and the operator shall have the duty to ensure that the viewing booths are in a clean and sanitary condition at all times. Cleaning procedures shall include all of the following: the cleaning of all surfaces in the viewing booth using a disinfectant and the removal of trash, bodily fluids or excrement after each time the viewing booth is used by a patron and inspection of the booth for any holes or openings in the walls of the viewing booth.

         E.   Each viewing booth shall contain a sign which states the following in at least 48-point type:

            1.   That no loitering is permitted in the viewing booth.

            2.   That sexual activity is not permitted on the premises.

            3.   That the occupancy of the viewing booth is limited to one person.

            4.   That sexual activity can cause the transmission of the Human Immunodeficiency Virus (HIV) or sexually transmitted diseases.

            5.   That the permit premises including this viewing booth is subject to periodic inspection by the City of Norwalk and/or the employees of the permit premises.

            6.   That persons under the age of 18 are not permitted in the permit premises.

         F.   The permit premises shall be equipped with overhead lighting fixtures of sufficient intensity to illuminate the permit premises at an illumination of at least five footcandles as measured at floor level.

      (2)   Standards of conduct for patrons.

         A.   No more than one patron at a time shall be permitted in a viewing booth.

         B.   No patron shall appear in a state of nudity or engage in any specified sexual activity in the subject premises.

         C.   No patron under the age of eighteen shall be permitted upon the permit premises.

         D.   No patron shall loiter in the viewing booth.

   (c)   Standards Pertaining to Adult Bookstores, Adult Novelty Stores and Adult Video Stores. Adult bookstores, Adult Novelty Stores and Adult Video Stores shall comply with the following regulations:

      (1)   All books, magazines, videos, slides, or other visual depictions which are characterized by nudity or specified sexual activities or sexual novelties shall be segregated and closed off from other portions of the store.

      (2)   No books, magazines, videos, slides, or other visual depictions which are characterized by nudity or specified sexual activities or sexual novelties shall be visible from the outside of the permit premises.

      (3)   No advertising for such items shall be posted or otherwise visible except where the items are permitted to be displayed.

      (4)   No patron under the age of eighteen shall be permitted in the area where such items are offered for sale.

      (5)   The area in which such items are offered for sale shall contain a sign which states the following in at least 48-point type:

         A.   That no loitering is permitted in the viewing booth.

         B.   That sexual activity is not permitted on the premises.

         C.   That sexual activity can cause the transmission of the Human Immunodeficiency Virus (HIV) or sexually transmitted diseases.

         D.   That the permit premises including this area is subject to periodic inspection by the City of Norwalk and/or the employees of the permit premises.

         E.   That persons under the age of 18 are not permitted in the permit premises.

      (6)   The permit premises shall be equipped with overhead lighting fixtures of sufficient intensity to illuminate the permit premises at an illumination of at least five footcandles as measured at floor level.

      (7)   Standards of conduct for patrons.

         A.   No patron shall appear in a state of nudity or engage in any specified sexual activity in the subject premises.

         B.   No patron under the age of eighteen shall be permitted upon the permit premises.
