1301.03 PERMISSION TO USE PART OF STREET.
   (a)   Mayor May Grant Use of Street. Upon an application being made to the Mayor, he may grant any person engaged in the construction, repair or improvement of any building or structure permission to use fractional parts of the street, lanes, alleys or other public places, not inconsistent with the rights of the public, provided such use is necessary for the purpose of such construction or repair.

   (b)   Time and Space Limitation. The permission granted shall be limited to a reasonable time and shall specify the space permitted to be used or occupied, which space shall in no case exceed more than one-half of such street, lane, alley or other public space.

   (c)   Space To Be Guarded. The person to whom such permission is granted shall use diligence in the occupancy of such space by necessary guards and barriers and by placing lights or other proper danger signals in the night season, so as to prevent damage or injury to the person or property of another.
