945.02 SYSTEM OF GARBAGE PICKUP.
(a) Refuse.
(1) Except as otherwise provided by law, the City shall, at no charge, pick up refuse produced by residents within the confines of the City once a week, in accordance with a schedule established by the Director of Public Service and Safety.
(2) The City shall pick up a maximum of three bags or cans or combination thereof, with a total maximum capacity not to exceed 100 gallons or 120 pounds for each dwelling house or apartment unit.

(3) Every can of refuse placed for curbside pickup shall have a secure lid, free of leaks, covering the top of the can. The City may not pick up any can of refuse without a lid so secured.

(b) Yard Waste.
(1) Mobile home, modular homes or houses. Each resident household occupying a mobile home, modular home, manufactured home or house located within the limits of the City shall be entitled to have the City pick up yard waste generated on such real property in cans supplied by the resident as follows:
A. The Service Director shall establish a schedule for the pick-up of yard waste within the City.
B. Yard waste will be picked up by the City when such waste is placed in brush bundles or when placed within a can to be supplied by the resident. Such can shall be no larger than thirty gallons and shall weigh no more than forty pounds when filled.
C. Yard waste shall be placed in such cans as are to be free from refuse.
D. The City shall be required to pick up a maximum of two yard waste cans.
(2) Apartments. Each apartment building containing dwelling or living units wherein persons occupy and reside shall be entitled to place up to two cans containing yard waste per apartment building in conformity with above.
(c) Recycling. To encourage recycling activities, the City will, free of charge, pick up all properly identified recyclables.
(d) The City shall not be responsible for picking up any garbage as defined within this chapter from any property where the Safety/Service Director determines that access to such property is obstructed, unsafe, or blocked. In the event the Safety/Service Director determines that access to such property is obstructed, unsafe or blocked, the Service Director shall notify the owner or custodian of such property to remove or cause to remove such garbage and it shall then be the responsibility of the owner of such property or the custodian of such property to have such garbage removed and properly discarded at their cost. Any refuse remaining in such property for more than one day after the Service Director provides the notice mentioned herein shall constitute a public nuisance and shall subject the owner or custodian of such property to any penalties provided in Chapter 521 of the General Offenses Code.
(e) Unless otherwise provided by the Service Director, yard waste shall be picked up as provided herein by the City between April 1 to November 1 of any particular year.
(f) Compost. The City shall provide without charge to the citizens of the City the ability to dispose of yard waste, compost and related material at a compost pile located at a compost area within the City as provided herein:
(1) The City shall operate, maintain, staff, and police a compost area upon which a compost pile shall exist, on property owned by the City, west of Plank Road on Austie Shadle Drive.
(2) The compost area and the compost pile shall be staffed as determined by the Mayor and Service Director with such hours of operation as determined by the Service Director, and which hours shall be posted accordingly.
(3) No person shall deposit compost, yard waste or any other matter on the compost pile at such time as the compost area and pile is closed, nor shall any person, unless otherwise authorized by the City, enter onto the compost area during a time that such area is closed.
(4) No person who is not a resident of the City shall use the compost area or deposit yard waste, compost or any other material on the compost pile. Any person desiring to use the compost pile or compost area shall first provide the City with a valid driver’s license. No person shall use the compost area or compost pile without first producing such license. No person shall be admitted to the compost pile or compost area without such license.
(5) No person shall deposit any material on the compost pile that is not yard waste, compost or related material. In addition to any other penalty provided by law, any person attempting to deposit such material may be asked to leave the compost area by the City.
(6) No person shall use the compost area or pile for commercial purposes or for a commercially related activity.
