553.04 RAILROAD CROSSINGS.
(a) Construction. Wherever any railway track crosses any street, lane, alley or public highway within the City, the company owning or operating the railway, at each of such crossings and at its own expense, shall construct, place and maintain, between and on a level with the tracks of the railway, plank and other suitable material in such a manner as to insure the safe and convenient crossing by pedestrians, animals and vehicles. The provisions of this section shall apply to the altering or repairing of the crossing, as well as to the construction thereof, whenever, the same may be ordered or becomes necessary.

(b) Failure to Construct Crossings. Upon the failure or neglect of any railway company to comply with the provisions of subsection (a) hereof, the Mayor shall notify the owners, operators or managers of the company to comply therewith. If, after the expiration of fifteen days from the service of the notice, the company still neglects or fails to do so, the Mayor shall certify the fact of the failure or neglect to Council, which shall direct the Director of Public Service and Safety to construct, alter or repair such crossing in the manner herein prescribed. The cost and expense of such construction, alteration or repair shall be charged against the railway company and collected as provided by law or ordinance of the City.
