541.09 PILFERING RECYCLABLES.
   (a)   There hereby is established the offense of pilfering recyclables.
 
   (b)   Any person with purpose to deprive the City of Norwalk and or the Litter Control Agency organized and authorized by the City of certain materials more fully defined in subsection (c) hereof who obtains or exerts control over such materials without the consent of such City or Agency shall be deemed in violation of this section.
 
   (c)   The specific materials referred to in subsection (b) hereof, shall be glass bottles and jars, steel and aluminum cans, corrugated/cardboard products, plastic goods including, but not limited to milk jugs, detergent bottles, 2 liter pop bottles and similar materials left for collection by the City of Norwalk and or the Norwalk Litter Control Department and the Norwalk Recycling private, non-profit organization.
 
   (d)   Any violation of this section shall constitute a minor misdemeanor and shall be punishable with a maximum fine of one hundred dollars ($100.00); if the offender has previously been convicted of any violation of this section, a violation of this section shall constitute a misdemeanor of the fourth degree and shall be punishable with the maximum fine of two hundred fifty dollars ($250.00) and thirty days in jail; if the offender has previously been convicted of two or more violations of this section, a violation of this section shall constitute a misdemeanor of the first degree punishable by a maximum fine of one thousand dollars ($1,000) and six months in jail.
