§ 93.35 OPEN FIRES PROHIBITED; EXCEPTIONS.
   No person, firm, corporation, or public agency shall ignite, cause to be ignited, permit to be ignited, or suffer, allow, or maintain any open fire within the city limits, except as follows:
   (A)   Fires used for burning of leaves and small limbs shall be permitted in the city limits;
   (B)   Fires used only for cooking of food for human beings or for recreational purposes or fires to provide warmth in winter months for persons whose occupation causes them to be working outdoors;
   (C)   Flare stacks for the combustion of waste gases provided that where used in petroleum refineries such stacks be equipped with smokeless tips;
   (D)   Fires set for prevention of a fire hazard, including disposal of dangerous materials where no safe alternate is available, provided prior approval is obtained from the proper authorities;
   (E)   Fires set for the purpose of weed abatement, land clearing, disease, and pest prevention, provided prior approval is obtained from the City Fire Chief;
   (F)   Fires set in connection with agricultural operations related to growing or harvesting crops, provided prior approval is obtained from the City Fire Chief; and
   (G)   Fires set for the purpose of bona fide instruction and training of industrial employees in the methods of fighting fires, provided notice is given in each instance to the Chief of the Fire Department five days in advance by the official in charge stating the following:
      (1)   The name, organization, address, and telephone number of the person submitting notice;
      (2)   The exact location where open burning will be used and the type and quantity of material to be burned;
      (3)   The schedule date for burning. Should there be a postponement, the Fire Chief must be notified of the rescheduled date for burning before the burning shall take place; and
      (4)   Such fire is necessary for bona fide instruction and training.
