1254.05 APPEALS TO BOARD ON QUESTIONS OF INTERPRETATION AND ENFORCEMENT.
   (a)   It is the intent of this Zoning Code that all questions of interpretation and enforcement shall be first presented to the Building and Zoning Inspectors, and that such questions shall be presented to the Board of Zoning and Building Appeals only on appeal from a decision of the Building and Zoning Inspectors, and that recourse from the decisions of the Board of Zoning and Building Appeals shall be to the courts as provided by law, and particularly by Ohio R.C. Chapter 713.
   (b)   It is further the intent of this Zoning Code that the duties of the City Council in connection with this Zoning Code shall not include hearing and deciding questions of interpretation and enforcement that may arise. The procedure for deciding such questions shall be as stated in this section and this Zoning Code. Under this Zoning Code, the City Council has only the duties:
      (1)   Of considering and adopting or rejecting proposed amendments to or the repeal of this Zoning Code, as provided by law; and
      (2)   Of establishing a schedule of fees, charges and expenses, as stated in Section 1252.03.
