1236.11 STORM WATER, GRADING, EROSION CONTROL, SWPPP, NPDES.
   (a)   Storm Water.
      (1)   Subdivision improvements shall be designed to manage increased or otherwise altered storm water runoff resulting from development of the subdivision and from the subsequent use of and construction on the subdivision lots, to minimize erosion and downstream damage, and to comply in all other respects with local, County, State and Federal regulations.
      (2)   A storm water sewer or sewers shall be installed in all new subdivisions.
      (3)   Where a public storm water sewer is reasonably accessible, as determined by the City Engineer, the subdivider shall connect such storm drainage structure, including lateral connections, as required by Engineering Construction Standards.
      (4)   Where a public storm water system is not reasonably accessible as determined by the City Engineer, but where plans for this storm water drainage system in the district in which the subdivision is located have been prepared and officially approved, the subdivider shall install drainage facilities as required by Engineering Construction Standards in conformity with such official plans.
      (5)   Whenever the construction of streets and necessary storm water systems in a subdivision is such that the direction of storm water flow is diverted and affects surrounding properties, the subdivider shall obtain sufficient drainage easements to provide adequate disposal of the storm water.
      (6)   Storm drainage, including drain tile around a basement, shall not be permitted to empty into any sanitary sewer.
      (7)   Storm water improvements shall be designed and constructed in conformance with the Summit County Storm Water Management Program Guidelines (unless otherwise superseded by standards adopted by the City) and other standards adopted in the Engineering Construction Standards.
      (8)   Storm water improvements shall be designed to comply with the requirements of the National Pollutant Discharge Elimination System (NPDES) regulations effective in the City and with the City Storm Water Management Program.
      (9)   The subdivider and successors in ownership of lots within the subdivision shall be subject to the requirements of City ordinances regarding the establishment of storm water facility maintenance districts.
   (b)   Topsoil Protection.
      (1)   No topsoil shall be removed from the site or used as spoil.
      (2)   Topsoil moved during the course of construction shall be redistributed to provide general coverage on all areas on the subdivision and shall be stabilized on slopes of 12% or over, as shown on the final grading plan.
      (3)   Where seeding is required, rye grass is prohibited. A grass seed indigenous to the climatic and physical conditions of the site shall be used.
