(a) There is hereby established in and for the City a Cemetery Fund. The Cemetery Fund is to provide for the deposit and investment of funds received from the sale of cemetery lots and the disbursement of said funds or interest thereon for the perpetual care of the cemeteries located within the City and maintained by the City.
(b) Cemetery plots or graves may be sold at the Western Star Cemetery. The Director of Public Service is hereby authorized and directed to sell lots and furnish labor and equipment for the opening and closing of plots at the Western Star Cemetery. The Director of Public Service shall, upon the receipt of payment according to the schedule of fees set forth in Section 1062.02, turn over such receipts to the Director of Finance for deposit in the Cemetery Fund.
(c) The ownership or title to the Western Star Cemetery land remains in the name of the City. Cemetery graves, lots or plots may not be sold to another individual by the deeded owner. Graves, lots or plots shall only be transferred to the City for the original purchase price plus 20 percent of the increase between the rate in effect at the time of purchase and the rate in effect at the time of sale to the City.
