856.11 OPERATION OF CLASS I SKILL-BASED AMUSEMENT ARCADES.
   (a)   No person under the age of 18 years shall be permitted on the premises.
   (b)   No doors shall be locked or blocked preventing ingress and egress by members of the public while patrons are on the premises.
   (c)   The operator shall adopt and enforce a no loitering policy on the premises.
   (d)   The premises of every skill-based amusement arcade shall be equipped with exterior lighting of sufficient intensity to illuminate every means of ingress and egress and adjacent parking areas.
   (e)   Each skill-based arcade shall be maintained so that it complies with all applicable building code regulations and is handicap accessible throughout.
   (f)   No skill-based devices shall be placed in restrooms, offices or other non-public or private areas.
   (g)   The operator shall maintain a detailed and complete record of each skill-based device taken out of play for any reason, including but not limited to, machine malfunction. The record shall include, but not be limited to the following: name of operator taking the machine out of play; name and address of player who last played; the prize amount reflected as won but not paid or lost by the arcade; a description of the malfunction; a description of how the machine was designed to operate; time and date of removal from play; make, model and serial number of the machine. Said record shall be maintained on the premises for at least two years from the date of removal. Further, the record shall be available for inspection during regular business hours by the Administrative Officer or his or her designee. No machine shall be returned to the premises until it has gone through the inspection and approval process.
   (h)   (1)   Class I skill based amusement arcades shall operate only between the hours set forth below:
         A.   Sundays: 1:00 p.m. to 10:00 p.m.
         B.   All other days: 10:00 a.m. to 12:00 a.m.
      (2)   No operator shall permit any person to operate any skill-based device during any time other than specified herein.
      (3)   Notwithstanding anything to the contrary in subsection (a) above, an operator shall be permitted to operate its Class I skill based amusement arcades on Friday and Saturday from 10:00 a.m. to 2:00 a.m. of the following day provided, that on any such Friday or Saturday, the operator provides security at the Class I skill based amusement arcades from 10:30 p.m. to 2:30 a.m. of the following day in accordance with a security plan approved by the Chief of Police (or his designee). All security plans shall be submitted by the operator to the Chief of Police in writing and all approvals of security plans by the Chief of Police (or his designee) shall be in writing.
   (i)   Each operator shall maintain a record of the full name, address, telephone number, date, tax identification number and gross value amount for each player receiving a prize, consideration or anything of value exceeding six hundred dollars ($600.00). This record shall be filed with the Finance Director at least quarterly. Further, such record shall be available for inspection by the Administrative Officer or his or her designee during regular business hours for a period of two years. All prize winnings are to be reported as required under State and/or Federal law.
   (j)   Each operator shall clearly post in a conspicuous place all circumstances in which a player may not be reimbursed or receive a prize for the value of winnings, credits, rewards or prepayments.
   (k)   Each operator shall conspicuously display at each skill-based amusement device the established prize or reward for each play. This information shall be posted so that the player can easily observe it prior to and during play.
   (l)   Each operator shall make available and have on display forms as prescribed by the Administrative Officer for the recovery of losses pursuant to Ohio R.C. Chapter 3763.
   (m)   Each operator, employee and agent thereof shall wear a name identification nameplate during work hours.
   (n)   All on-premise food service shall comply with State and local health regulations.
   (o)   No weapon, firearm, or dangerous ordnance is permitted on the premises and shall be posted at each entrance.
