848.05 PUBLIC HEARINGS ON PERMIT APPLICATIONS.
   (a)   Hearing by the Planning Commission. (EDITOR'S NOTE: Subsection (a) was repealed by Ordinance 37-1998, passed August 24, 1998.)
   (b)   Hearing by the City Council. The City Council shall, before granting a drilling unit authorization, schedule a public hearing, the date and time of which shall be established by City Council, and shall cause all property owners and residents within the City of Norton within 1,000 feet of the wellhead to be notified of such hearing, in writing, all by regular mail, and notice shall also be given of said hearing by publication in a newspaper of general circulation in Norton. The notice to be mailed must carry a map showing the specific location of the well. The public hearing must occur not less than three weeks prior to the commencement of drilling. It shall be sufficient notice to all the residents of any one residential unit to address the notice to "Resident or Residents" at the mailing address of the residential unit.
   (c)   Compliance Required. Compliance with the hearing provisions of this chapter shall be a mandatory condition precedent to the commencement of drilling under a permit.
