§ 94.999 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   Any person, including any business entity, non-profit entity or public utility, who does not comply with the provisions of §§ 94.001 through 94.007 or permits an opening or excavation to be undertaken that is not in compliance with §§ 94.001 through 94.007 shall be subject to a summary criminal proceeding before the magisterial district justice as provided by the Pennsylvania Rules of Criminal Procedure, as may be amended from time to time. Upon a finding of a violation, a fine of not less than $450 nor more than $1,000, plus costs of prosecution, including court costs and reasonable attorney fees incurred by the borough to prosecute the violation, shall be imposed, and such person may be subject to imprisonment of up to 15 days in the event such fines and costs are unpaid. Each day that such violation(s) continues shall be a separate violation of §§ 94.001 through 94.007.

   (C)   Any person who shall change or remove any stake, stone, mark or other designation by which any grade or line so given is indicated, shall, upon conviction thereof, be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 94.035 through 94.047 continues or each section of §§ 94.035 through 94.047 which shall be found to have been violated shall constitute a separate offense.

   (D)   Any person, firm or corporation who shall violate any provision of §§ 94.035 through 94.047, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 94.035 through 94.047 continues or each section of §§ 94.035 through 94.047 which shall be found to have been violated shall constitute a separate offense.

   (E)   Any person, firm or corporation who shall violate any provision of §§ 94.060 through 94.062, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 94.060 through 94.062 continues or each section of §§ 94.060 through 94.062 which shall be found to have been violated shall constitute a separate offense.

   (F)   Any person, firm or corporation who shall violate any provision of §§ 94.075 and 94.076, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 94.075 and 94.076 continues or each section of §§ 94.075 and 94.076 which shall be found to have been violated shall constitute a separate offense.
