633.14 FIXED SOURCE NOISE LEVELS.
   (a)   (1)   Except as provided for in division (b) of this section in RA Rural Residential, R Suburban Residential, C Commercial, M-1 Light Industrial and M-2 Heavy Industrial Districts, on and after six months after the effective date of this chapter (Ordinance 83-54, passed October 13, 1983), no person shall operate any fixed machinery or equipment, or similar mechanical device, in any manner so as to create any noise which would cause the noise level measured at the property line of the property affected by the noise emission to exceed the applicable fixed noise level in this section. Noise limits shall not exceed the following:

unless the person creating the noise has filed an application for a variance in accordance with Section 633.19.
      (2)   If the measurement location is on a boundary between two zoning districts, the lower sound level shall apply.
   (b)   The provisions of division (a) of this section shall not be applicable to any emergency signaling devices required by law, nor to any stand-by equipment operated only in emergency situations, provided that such stand-by equipment does not emit noise at a level in excess of seventy-five dbA when measured at the property line of the property whereon it is located.
   (c)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
