(a) No person shall create loud and excessive noise in connection with the loading or unloading of any vehicle or the opening and/or destruction of bales, boxes, crates and containers. If any noise, for any duration, is seven dbA over the fixed source noise level for the zone, when measured at the property line of the property affected by the noise emission, between the hours of 9:00 p.m. and 7:00 a.m. of the following day, such noise shall be conclusively deemed to be unnecessary and excessive.
(b) Whoever violates this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
