8-4-3: RECEPTACLE REQUIREMENTS:
   A.   The owner, occupant or lessee of any premises in the village, upon which shall accumulate any garbage, ashes or miscellaneous waste, shall provide or cause to be provided at his expense, and shall maintain clean and in good repair, adequate separate receptacles of the following material, construction and capacity:
      1.   Residential receptacles for garbage shall have a close fitting cover, shall be watertight, and shall have a capacity of not more than thirty two (32) gallons.
      2.   At each location, the total amount of garbage and miscellaneous waste to be collected each week shall not exceed three (3) 32-gallon receptacles or its equivalent unless stickers are purchased and affixed for excess cans or bags.
      3.   The occupant, tenant, owner or his agent of any three-family residence or larger, as well as commercial buildings with attached apartments, and any commercial or business refuse generators shall use dumpsters, and the following conditions shall be maintained by every occupant, tenant, owner or his agent of said premises:
         a.   Dumpsters must be of sufficient capacity to contain all garbage between pick ups.
         b.   Dumpsters must be covered with close fitting covers, unless such dumpsters contain no animals or vegetable or food wastes.
         c.   Dumpsters used for disposal of large amounts of food wastes causing foul, offensive or disagreeable odors shall be emptied as needed.
         d.   Dumpsters shall be:
            (1)   Stable while empty or loaded;
            (2)   Equipped for mechanical dumping;
            (3)   Durable;
            (4)   Leakproof and verminproof; and
            (5)   Maintained in good repair.
   B.   Any person subject to the provisions of this section may file a written request for exemption with the village clerk, which shall be considered and acted upon by the village board. Such request shall be based upon factual circumstances which would make the application of the requirements an undue hardship or burden upon the applicant, or otherwise demonstrate the requirements to be inappropriate.
