8-1-14: DISCONTINUANCE OF SERVICE PROCEDURE:
   A.   Notice Of Delinquency; Options:
      1.   If user's billed charges of water and/or sewer service are not paid within fifteen (15) days after such billed charges become due, the village shall provide written notice of delinquency/termination to the user, which shall state the amount of the delinquency and the date of commencement of the delinquency (the due date). In addition, such notice shall inform the user of the following options:
         a.   Immediate payment of the delinquency; or
         b.   Written agreement, within fifteen (15) days, to pay the balance of the delinquency within one year, in regular monthly installments.
      2.   The notice of delinquency/termination will inform the user that service will be terminated unless one of the two (2) options set out in subsection A1 of this section is exercised.
   B.   Interest Penalty: Unless payment is made or a written agreement is signed within fifteen (15) days of receipt of the notice of delinquency, an interest penalty of five percent (5%) per annum shall be assessed against the user's delinquency, applicable to the delinquency period commencing on the due date.
   C.   Agreement For Installment Payments:
      1.   In order to elect to repay the delinquency over the course of one year, the user shall enter into a promissory note with the village, whereby the user shall agree to make the aforesaid monthly installments which shall be added to the regular monthly charge assessed against the user. If the user violates the terms of the promissory note, such user's water or sewer service shall be discontinued without further notice, and shall not be reinstated until all past due bills are paid in full, including interest, and together with the cost and charges for the reinstatement of such service.
      2.   Notwithstanding anything herein to the contrary, the village retains the discretion to allow a payment agreement to extend beyond one year if circumstances warrant as determined by the village president. The village president is authorized to designate his authority hereunder to the water/sewer liaison/chair as determined by the village president.
   D.   Reconnection Of Service; Fee: If a user's service is disconnected pursuant to this section, there shall be a reconnection fee of one hundred dollars ($100.00). such payment, as well as such delinquency and interest associated therewith, shall be paid to the village clerk, or such other person(s) assigned for the purpose of receiving such funds, by cash or certified check prior to reinstating water or sewer service. If the reconnection is requested to occur outside of regular business hours of the Utica Public Works Department, then the reconnection fee shall be two hundred dollars ($200.00).
