7-1-5: DISTURBING SURFACES:
   A.   Excavations:
      1.   Permit Requirements: It shall be unlawful to make any excavation in or tunnel under any public street, alley, sidewalk or other public place in the village without having first secured a permit therefor. Applications for such permits shall be made to the village clerk and shall specify the intended location and purpose of the excavation.
      2.   Bond: No person shall make any such excavation or tunnel without first having secured and furnished the village with a copy of, or certificate of, a bond or policy conditioned to indemnify and hold the village harmless from any loss, damage or liability resulting from the work done or any acts or omissions in connection therewith.
      3.   Restoration Of Excavated Area: Any such person making any such excavation shall refill the same properly and shall restore the surface to its former condition as soon as possible.
      4.   Supervision: All such excavations, refills and resurfacing shall be made subject to the supervision and under the direction of the superintendent of public works. (1966 Code § 112)
   B.   Openings:
      1.   Permit Required: It shall be unlawful to construct or maintain any opening or stairway in any public street or alley or sidewalk or other public place without a permit from the president and board of trustees.
      2.   Protective Devices: All such lawfully maintained openings shall be guarded by a suitable strong cover or railing, to the approval of the superintendent of public works. (1966 Code § 113)
