5-8-2: DEFINITIONS:
For the purpose of these regulations, the following terms, phrases and words shall have the meanings herein expressed:
ABANDONED AND VACANT PROPERTY: Any property which has been abandoned and left vacant by the property owner. Abandonment shall be determined by the enforcement officer using reasonable discretion and judgment as to whether any person is occupying the said premises.
ABATE: To put an end to any condition which is considered in violation of this chapter.
CITY: North Salt Lake City.
ENFORCEMENT OFFICER: Either an officer assigned by the North Salt Lake City chief of police or the city code enforcement officer is hereby designated to administer and enforce the provisions of this title.
ERADICATION: The removal and cleaning of graffiti by chemical or any other method approved by the city.
GRAFFITI: Any form of unauthorized printing, writing, spraying, scratching, affixing or inscribing on the property of another, regardless of the content or nature of the material used in the commission of the act. For the purposes of Utah Code Annotated section 10-11-1 et seq., graffiti is deleterious and unsightly.
OWNER/RESPONSIBLE PARTY: Any person who, alone or jointly or severally with others:
   A.   Has legal title to any premises, dwelling or dwelling unit, with or without accompanying actual possession thereof; or
   B.   Has charge, care or control of any premises, dwelling or dwelling unit, as legal or equitable owner, agent of the owner or lessee, or is an executor, executrix, administrator, administratrix, trustee or guardian of the estate of the owner.
PERSON: Any individual or public or private corporation and its officers, partnership, association, firm, trustee, executor of an estate, the state of Utah or a department, institution, bureau, agency, municipal corporation, county, city political subdivision, or any legal entity recognized by law.
PROPERTY: Any form of real property, including a habitable structure or any structure that is appurtenant thereto, object, or anything that is visible or tangible, specifically including, but not limited to, retaining walls, fences, signage, automobiles, etc.
STRUCTURE: Anything constructed or erected which requires location on or below the ground, specifically including, but not limited to, fences, walls, poles, buildings or sheds.
UNSIGHTLY: Offensive to the visual senses as reasonably determined by the city. (Ord. 09-08, 3-31-2009)
