3-2-1: DEFINITIONS:
The following words and phrases used in this chapter shall have the following meanings unless a different meaning clearly appears from the context:
ALCOHOLIC BEVERAGE: Means and includes "beer" and "liquor", as defined in this section.
BEER: Any beverage containing not less than one-half of one percent (0.5%) of alcohol by weight and obtained by the alcoholic fermentation of an infusion of decoction of any malted grain or similar products. "Heavy beer" means beer containing more than three and two-tenths percent (3.2%) of alcohol by weight. "Light beer" means beer containing not more than three and two-tenths percent (3.2%) of alcohol by weight. "Beer" includes ale, hard cider, stout and porter.
CITY: The municipal corporation of North Salt Lake City.
CITY COUNCIL: The city council of North Salt Lake City.
LICENSED PREMISES: Any room, house, building, structure or place occupied by any person licensed to sell beer on such premises under this chapter; however, in any hotel or other business establishment, an applicant for a class C license may designate a room or portion of a building of such business for the sale of beer, and said portion of the building of such business shall be specifically designated in the application. Bowling alleys which are issued a class C license under this chapter shall be permitted to allow the consumption of beer at scoring areas on lanes, provided it is served in plastic, paper or styrofoam containers. Licensee's holding a class E beer license shall be permitted to allow the consumption of beer on golf course premises accessible to the general public.
LIQUOR: Means and includes alcohol, or any alcoholic, spirituous, vinous, fermented, malt, or other liquid or combination of liquids, a part of which is spirituous, vinous, or fermented, and all other drinks or drinkable liquids, containing more than one-half of one percent (0.5%) of alcohol by weight; and all mixtures, compounds or preparations, whether liquid or not, which contain more than one-half of one percent (0.5%) of alcohol by weight, and which are capable of human consumption. The term "liquor" shall not include "light beer".
LOCAL CONSENT: As used herein means a request for the City to give consent to the Utah Department of Alcoholic Beverage Control for the Department to issue a license or permit to an applicant.
NUISANCE: Any room, house, building, structure, place or licensed premises where:
   A.   Alcoholic beverages are manufactured, sold, kept, bartered, stored, given away or used, or where persons resort for drinking alcoholic beverages contrary to the alcoholic beverage control act of Utah; or where
   B.   Intoxicated persons are permitted to loiter about, or profanity, indecent, immoral, loud or boisterous language or immoral or lewd conduct is permitted or carried on; or where
   C.   Minors are permitted to purchase or drink beer, or where minors are permitted to enter upon or loiter upon class C licensed premises, except bowling alleys; or where
   D.   Laws or ordinances are violated by the licensee or his agents or patrons with consent or knowledge of licensees upon such premises which tend to affect the public health, peace or morals.
RETAILER: Any person engaged in the sale or distribution of beer to the consumer.
SELL OR TO SELL: To solicit or receive an order for; to keep or expose for sale; to deliver for value; to peddle; to possess with intent to sell; to traffic in; for any consideration, promised or obtained, directly or indirectly, or under the pretext or by any means whatsoever to procure or allow to be procured for any person; and "sale", when so used, shall include every act of selling as above defined.
WHOLESALER: Any person other than a manufacturer engaged in the importation for sale, or in the sale of alcoholic beverages in wholesale or jobbing quantities to the commission or to retailers. (1989 Code § 9-411; amd. Ord. 93-6, 9-22-1993; 2012 Code; Ord. 2021-01, 2-2-2021)
