1-5-6: MEETINGS; PROCEDURE AND CONDUCT:
   A.   Regular Meetings: The city council shall hold two (2) regular meetings, which shall be held on the first and third Tuesdays of each month, at 20 So. Hwy 89 (city offices), which meetings shall begin promptly at seven o'clock (7:00) P.M.
      1.   If the meeting date is a legal holiday, then the meeting shall be held at the same time and place above described on the next following day which is not a legal holiday, or as previously adopted by ordinance at the beginning of the year.
      2.   The city council may, by ordinance, provide for a different time and place for holding regular meetings of the governing body.
      3.   Closed meetings may be held, but shall comply with all federal and state laws. Closed meetings, because of their sensitive nature, shall not be open to the public or media. (1989 Code § 3-502; amd. 2012 Code)
   B.   Special Meetings:
      1.   The mayor or two (2) council members may order the convening of a special meeting of the council.
      2.   Each order convening a special meeting of the council shall:
         a.   Be entered in the minutes of the council;
         b.   Provide at least three (3) hours' notice of the special meeting.
      3.   The city recorder shall serve notice of the special meeting on each council member who did not sign the order by delivering the notice personally or by leaving it at the member's usual place of abode.
      4.   The personal appearance by a council member at a special meeting of the council constitutes a waiver of the notice required under subsection B3 of this section. (2012 Code)
   C.   Compelling Attendance: The governing body may compel the attendance of its own members at its meetings and provide penalties it considers necessary for the failure to comply with the attendance requirements. (1989 Code § 3-505; amd. 2012 Code)
   D.   Quorum: The number of the governing body necessary to constitute a quorum is three (3), excluding the mayor. (1989 Code § 3-504; amd. 2012 Code)
   E.   How Vote Taken: A roll call vote shall be taken and recorded for all ordinances, resolutions and any action which would create a liability against the municipality and in any other case at the request of any member of the governing body by a "yes" or a "no" vote and shall be recorded. Every resolution or ordinance shall be in writing before a vote is taken. (1989 Code § 3-506)
   F.   Minimum Vote Required:
      1.   The minimum number of yes votes required to pass any ordinance or resolution, or to take any action by the governing body, unless otherwise prescribed by law, is a majority of all voting members of the council, without considering any vacancy in the council.
      2.   a. Any ordinance, resolution or motion of the governing body having fewer favorable votes than required in this subsection is defeated and invalid.
         b.   Notwithstanding subsection F2a of this section, a governing body meeting may be adjourned to a specific time by a majority vote of the governing body, even though the majority vote is less than that required in this subsection.
      3.   A majority of the members of the governing body, regardless of number, may fill any vacancy in the governing body. (1989 Code § 3-507; amd. 2012 Code)
   G.   Reconsideration: Any action taken by the governing body shall not be reconsidered or rescinded at any special meeting unless the number of members of the governing body present at the special meeting is equal to or greater than the number of members present at the meeting when the action was approved.
