§ 156.042 CONDITIONAL USES.
   (A)   The following conditional uses may be located in the A-1 District, subject to the provisions hereof:
      (1)   Publicly owned or operated properties;
      (2)   Fish hatcheries, apiaries or aviaries;
      (3)   Forests and wildlife reservations or similar conservation projects;
      (4)   Fur farming for the raising of fur-bearing animals;
      (5)   Golf courses and clubhouses customarily accessory thereto, miniature golf, driving ranges and other similar activities operated as a business;
      (6)   Amusement parks, community baseball or athletic fields, racetracks, circus, carnivals or fairgrounds;
      (7)   Aviation fields or airports;
      (8)   Kennels, provided the buildings and pens shall be located not less than 300 feet from any district boundary;
      (9)   Government and private grain storage bins;
      (10)   Philanthropic or eleemosynary institutions and penal institutions;
      (11)   Public parks and playgrounds, including public recreation or service buildings, county fairgrounds and police and fire stations;
      (12)   State-approved public elementary or secondary schools; state-approved private or parochial schools having a curriculum equivalent to public elementary or secondary schools; postsecondary institutions that grant degrees, diplomas or certificates; and stadiums and dormitories in conjunction with the facilities if located on the campus;
      (13)   Railroad rights-of-way and sidings, but not including railroad yards, public utilities and their rights-of-way;
      (14)   Grain elevators;
      (15)   Mobile home parks, in accordance herewith;
      (16)   Seasonal dwellings;
      (17)   Veterinarian clinic;
      (18)   Livestock and poultry commercial feeding operations. This subchapter is not intended to prevent raising of domestic livestock or animals by a person for his or her own personal use, 4-H calf projects or similar family operations;
      (19)   Bank stabilization projects, sanitary landfills or other solid waste facilities;
      (20)   Mineral extraction, which shall include the following: oil wells, sand and gravel extraction, strip mine operations and quarries;
      (21)   Art and ceramic schools;
      (22)   Religious education centers;
      (23)   Recreational vehicle park;
      (24)   Wholesale nurseries and greenhouses with accessory retail outlets;
      (25)   Towers, telecommunication facilities and antennas, subject to the provisions hereof pertaining to same;
      (26)   Bed and breakfast guest home;
      (27)   Churches;
      (28)   One additional single or 2-family dwelling for the purposes of housing relatives or permanent agriculture workers;
      (29)   An agricultural dwelling site, public or private utility and facility site or cemetery site may be no smaller than 1 acre. The 1-acre minimum lot size shall not apply if the Nebraska Department of Environmental Quality approves the septic/soil absorption system and well locations;
      (30)   Cemetery or pet cemetery. A mausoleum, columbarium or crematory will be an accessory use to a cemetery; and
      (31)   Livestock and poultry commercial sales facilities located not less than ¼ mile from any residential dwelling, whether such residential dwelling is occupied or not. Keeping of any individual heads of livestock or poultry not to exceed 30 days.
   (B)   The following uses are allowed only in schools and churches as a conditional use:
      (1)   Two-family dwellings;
      (2)   Multiple dwellings containing more than 2 families in the same structure;
      (3)   Group housing or apartment projects, which may vary from the strict requirements of this chapter; provided that, the design is unique as it relates to the provisions of this chapter, for the type of development intended; and the design accomplishes the objectives of this chapter in reference to height and bulk of;
      (4)   Family child care homes;
      (5)   Manufactured homes which comply with the provisions of § 156.306;
      (6)   Elder daycare;
      (7)   Public libraries;
      (8)   Nursing home and convalescent homes;
      (9)   Child care centers or preschools;
      (10)   Medical clinic;
      (11)   Funeral home and mortuaries;
      (12)   Dance schools; and
      (13)   Retail shops, limited to arts, crafts, antiques, souvenirs, western wear, western goods, neighborhood grocery stores, and hunting and fishing stores.
