§ 130.058 NOTICE OF VIOLATION.
   Actual notice of the nature of the material harmful to minors shall be given to a person involved in or responsible for the material from the City Attorney on the basis of information lawfully gathered and supplied to him or her by the city’s Police Department or citizens.
   (A)   The notice shall be in writing and mailed by first class registered or certified mail to the alleged offender at his or her last known business or residential address.
   (B)   The notice shall state that:
      (1)   In the opinion of the City Attorney, the activity engaged in fails within the prohibitions of this subchapter;
      (2)   If the activity has not ceased within 7 days the city will take appropriate legal actions; and
      (3)   A declaratory judgment proceeding as described in this subchapter is available if a person engaged in the challenged activity wishes to initiate the legal determination of whether the activity is within the prohibition of this subchapter.
