§ 94.149 PENSION BENEFITS FOR FIREFIGHTERS SERVING ON AUGUST 7, 1965.
   (A)   The city shall pension all firefighters of the paid Fire Department who were serving as such on August 7, 1965, and who did not elect coverage under the provisions of Neb. RS 35-204—35-215, as they existed prior to January 1, 1984, whenever the firefighters shall have first served in such Fire Department for the period of 21 years and shall elect to retire from active service and go upon the retired list.
   (B)   The pension shall be paid by the city in the same manner as firefighters upon the active list are paid. The pension shall be at least 50% of the amount of salary the retiring firefighter is receiving at the time he or she goes upon the pension list.
   (C)   Any such firefighter who retires on or after age 55 with less than 21 years of service shall receive a pension of at least 50% of the salary he or she was receiving at the time of his or her retirement multiplied by the ratio of the years of service to 21.
   (D)   At the death of any such retired firefighter, the same rate of pension, as provided for in this section, shall be paid to the surviving spouse of the deceased firefighter during such time as the surviving spouse shall remain unmarried, and, if there is no surviving spouse, then the minor children, if any, of the deceased firefighter shall be paid the pension during their minority to the age of 18 years, except that, as soon as a child of the deceased firefighter shall become 18 years of age, the pension as to the child shall cease.
   (E)   Firefighters subject to division (A) of this section shall be subject to §§ 94.138 to 94.141, but shall be exempt from §§ 94.134, 94.135, 94.136, 94.137 and 94.142.
