§ 94.056 STORAGE OF FLAMMABLE AND COMBUSTIBLE LIQUIDS IN ABOVEGROUND TANKS.
   (A)   Storage of flammable and combustible liquids in aboveground storage tanks (AST) may be permitted by conditional use permit in I-2 heavy industrial districts on a minimum site of 10 acres of land.
   (B)   All other storage of flammable and combustible liquids in aboveground tanks (AST) is prohibited; provided, however, that aboveground storage tanks legally existing prior to the effective date of this section shall be allowed to exist until the time as any such storage tank is moved, removed or significantly altered; and further provided, that aboveground storage of Class III B liquids in 1 storage tank with a capacity equal to or less than 2,000 gallons and propane in 1 storage tank with capacity equal to or less than 1,000 gallons may be allowed only in the following zoning districts: B-2 business districts, I-1 light industrial districts, and 1-2 heavy industrial districts, by permit issued by the Fire Chief or his or her designee if the aboveground storage tank for Class III B liquids meets the criteria of the National Fire Protection Association Standard No. 30, and storage of propane meets the criteria of National Fire Protection Association Standard No. 58. Health care facilities which satisfy the definition of the National Fire Protection Association, Life Safety Code § 101, 2000 Edition, Chapter 18.1.1.2 and 19.1.1.2 shall be permitted to install emergency generators with built-in fuel tanks, on site, that comply with NFPA 30, Flammable and Combustible Liquids Code; NFPA 37, Standard for the Installation and Use of Stationary Combustion Engines and Gas Turbines; NFPA 54, National Fuel Gas Code; and NFPA 58, Liquified Petroleum Gas Code; and NFPA 110, Standard for Emergency and Standby Power Systems. STORAGE TANKS shall be defined by the National Fire Protection Association Standard No. 30.
   (C)   All aboveground storage tanks shall be fire resistant tanks that shall be tested and listed in accordance with UL (Underwriters Laboratory) 2080, entitled "Standard for Fire Resistant Tanks for Flammable and Combustible Liquids" and National Fire Protection Standard No. 30.
   (D)   In no event shall fuel to land density be greater than a maximum of 1,000 gallons per acre.
   (E)   All aboveground storage tank sites shall have the containment cells required by the Nebraska Department of Environmental Quality and the Environmental Protection Act, and any other requirements set forth by state and federal regulations.
   (F)   All aboveground storage tank sites shall provide a complete list of contents of such tanks, and a MSDS (Material Safety Data Sheets) to the North Platte Fire Department, identifying the materials stored on site in the aboveground storage tanks.
