(A) Along with the application for a city CCSESC permit, the applicant shall post security for compliance with all requirements imposed by the city CCSESC permit as well as necessary remedial work resulting from violation of any provision of this chapter in an amount of $500 per gross acre or $500 for each single or twin family home, whichever is greater. This amount shall apply to the maximum acreage of soil that will be simultaneously exposed during the projects construction as determined by the city.
(B) Acceptable forms of performance security payable to the city include the following:
(1) Performance bonds;
(2) Surety bonds;
(3) Money orders;
(4) Certificates of deposit;
(5) Certified check;
(6) Cashiers check.
(C) The application form signed by the applicant for a city CCSESC permit shall include the following commitment by the applicant:
"In addition to the performance security posted with this application, the undersigned applicant hereby agrees to defend, indemnify and hold the City harmless from any and all claims, damages or suites arising directly or indirectly out of any act of commission or omission by the applicant, or any employee, agent, assign or contractor or subcontractor of the applicant, in connection with applicant's City CCSESC Permit."
