955.09  BEACH AND POOL AREAS.
   (a)   Pool.
      (1)   The North Perry Village Townline Park Pool shall be operated annually from the first Saturday immediately following the last day of school in the Perry Local School district and remain open through Labor Day, unless otherwise determined by North Perry Village Parks Manager, in the interest of the health, safety and well-being of the residents of North Perry Village, that same should be closed.
      (2)   The hours of operation of the North Perry Village Townline Park Pool during the aforesaid season shall be 10:00 a.m. to 8:00 p.m. Monday through Saturday, and 1:00 p.m. to 8:00 p.m. on Sunday, unless otherwise determined by the North Perry Village Parks Manager, in the interest of the health, safety and welfare of the residents of the Village, that the pool should be closed.
   (b)   Beach Area.
      (1)   No person shall be permitted to swim in areas other than those in which it is plainly posted that such activity is permitted.
      (2)   All persons swimming at the beach area shall swim at their own risk.
      (3)   No person shall be permitted to jump or dive off of beach piers.
      (4)   No person shall be permitted to climb upon bluffs located in a beach area.
      (5)   No person shall carry, possess, store, use or otherwise bring upon a beach area any bottle, jar or other container made of glass.
      (6)   No person shall fish in any area other than those in which it is plainly posted that such activity is permitted.
      (7)   Any person found to be in violation of the provisions of this subsection (b) shall be subject to immediate removal from the North Perry Village Park and may be permanently enjoined from all North Perry Village Parks.
   (c)   Admission.  Admission of any individual to the pool and/or beach areas of North Perry Village Parks may be refused for the following reasons:
      (1)   Physical inability to care for oneself;
      (2)   Intoxication;
      (3)   Presence of open sores, wounds or running nose;
      (4)   Any type of contagious disease.
      (5)   Indecent swimwear;
      (6)   Wearing of blue jeans, overalls or other bathing attire that, in the opinion of the North Perry Village Parks Manager, her assistants, or lifeguards, presents a threat to the proper operation of the pool facility; or the North Perry Village Parks Manager, her assistants, or lifeguards, feel, in their opinion, that the safety and/or health  of the general public is in danger.
   (d)   Pool Regulations.
      (1)   No person shall run, jump, dive or roughhouse within the North Perry Village Townline Park Pool area.
      (2)   No person shall spit, spout water, splash excessively, blow their nose, or urinate within the North Perry Village Townline Park Pool.
      (3)   No person shall be permitted to use innertubes, floats, rafts or other flotation devices in the North Perry Village Townline Park Pool; except, the use of "water wing" type devices may be worn by young children while under the direct supervision and control of a responsible adult if written consent to the use of same has been previously obtained from the North Perry Village Parks Manager.
      (4)   Non-swimmers shall not be permitted in water deeper than their shoulders.  A person who cannot swim the length of twenty-five yards without interruption shall be considered a non-swimmer.
      (5)   No person shall use abusive or profane language within the confines of the North Perry Village Townline Park Pool.
      (6)   No group shall be permitted to monopolize a particular area of North Perry Village Townline Park Pool in such a manner as to limit the use of the pool by other swimmers, particularly younger children.
      (7)   No person, except properly authorized personnel, shall be permitted on or upon lifeguard stands situated within the confines of the North Perry Village Townline Park Pool.
      (8)   No person shall be permitted to hang, tug or play upon the life lines or ladders situated within the North Perry Village Townline Park Pool.
      (9)   No person(s), other than authorized personnel, shall be permitted to use North Perry Village Townline Park Pool area phone except in the case of emergency.
      (10)   No person shall be permitted to possess, carry, store or use any container that is made of glass within the North Perry Village Townline Park Pool area.
      (11)   Other than authorized personnel, no person shall be permitted within the confines of the North Perry Village Townline Park Pool area while dressed in street clothes.
      (12)   No person shall be permitted to enter the pool without first showering.
      (13)   No person shall be permitted to bring into the North Perry Village Townline Park Pool area gum, tobacco, cigarettes or other tobacco type products.
      (14)   No person shall climb upon the North Perry Village Townline Park Pool area fences.
      (15)   Any person found to be in violation of the provisions of subsection (d) hereof shall be subject to immediate removal from the North Perry Village Park and permanent enjoinment from all North Perry Village Parks.
