955.05  GENERAL CONDUCT.
   (a)   Disorderly Conduct; Intoxication.
      (1)   No person shall cause inconvenience, annoyance or alarm to another, by doing any of the following while within the boundaries of a North Perry Village Park:
         A.   Engaging in fighting, in threatening harm to person or property, or in violent or turbulent behavior;
         B.   Making unreasonable noise or offensively coarse utterance, gesture or display, or communicating unwarranted and grossly abusive language to any person, which by its very utterance or usage inflicts injury or tends to incite an immediate breach of the peace;
         C.   Insulting, taunting or challenging another, under circumstances in which such conduct is likely to provoke a violent response;
         D.   Hindering or preventing the movement of persons on a public street, road, highway or right of way, or to, from, within or upon public or private property, so as to interfere with the rights of others, and by any act which serves no lawful and reasonable purpose of the offender;
         E.   Creating a condition which is physically offensive to persons or which presents a risk of physical harm to persons or property, by any act which serves no lawful and reasonable purpose of the offender.
      (2)   No person, while voluntarily intoxicated shall do either of the following:
         A.   In a public place or in the presence of two or more persons, engage in conduct likely to be offensive or to cause inconvenience, annoyance or alarm to persons of ordinary sensibilities, which conduct the offender, if he were not intoxicated, should know is likely to have such effect on others;
         B.   Engage in conduct or create a condition which presents a risk of physical harm to himself or another, or to the property of another.
      (3)   A violation of any statute or ordinance of which an element is operating a motor vehicle, watercraft, aircraft or other vehicle while under the influence of alcohol or any drug of abuse, shall not be considered a violation of subsection (a)(2) hereof.
      (4)   When, to an ordinary observer, a person appears to be intoxicated, it is probable cause to believe such person is voluntarily intoxicated for purposes of subsection (a)(2) hereof.
   (b)   Noise.
      (1)   No person shall unreasonably make, continue, or cause to be made, continued, or permitted, any noise or disturbance within the boundaries of North Perry Village Parks.  This section shall not apply to any noncommercial public speaking and public assembly activities lawfully conducted within the North Perry Village Parks.
      (2)   The following acts and the causing or permitting thereof, are declared to be in violation of this section:
         A.   The sounding of any horn or signaling device on any automobile, watercraft, motorcycle or other motor vehicle in any Village Park except as a danger warning;
         B.   The using, operating or permitting the use or operation of any radio receiving set, musical instrument, phonograph, tape player, compact disc player or other machine or device for the producing, reproducing or recording of sound in such manner as to disturb the peace, quiet or comfort of any person(s) in a North Perry Village Park.
         C.   Yelling, shouting, hooting, whistling or singing in North Perry Village Park at any time in such a manner as to annoy or disturb the peace, quiet or comfort of any person(s) in a North Perry Village Park.
   (c)   Nuisance.  It shall be unlawful for any person to cause, commit or maintain, or to suffer to be caused, committed or maintained, any nuisance as defined by statute or common law in the State of Ohio.
   (d)   Penalty.  Whoever violates the provisions of subsection (a) hereof is guilty of a misdemeanor of the fourth degree.  Whoever violates the provisions of subsections (b) or (c) hereof is guilty of a minor misdemeanor.
