913.02  PLANTING OF UNDESIRABLE TREES PROHIBITED; REMOVAL.
   (a)   Trees within the Village which have undesirable characteristics such as excessively thick foliage, low branches, unpleasant odors, susceptibility to disease, or large root systems namely Poplar, Willow, Cottonwood, American Elm, Nut and Fruit Trees, Ailanthus, Mountain Ash and Oregon Maple shall not be planted within twenty-five feet of the right of way and from any Village or County owned utility, sewer system, underground pipe or conduit, and hereby declare any existing trees of these types a public nuisance subject to abatement pursuant to Section 1116.01.
   (b)   Any person who plants trees with the undesirable characteristics described in subsection (a) hereof, within twenty-five feet of the Village right-of-way and any Village or County owned utility, sewer system underground pipe or conduit or fails to remove such trees when directed to do so pursuant to Section 1116.01 shall be fined not less than twenty-five dollars ($25.00) nor more than two hundred fifty dollars ($250.00).
