909.03  CURB CUTS.
   (a)     Permit Required.  No person shall begin to construct, reconstruct or alter any curb cut without first obtaining a permit from the Zoning Inspector; provided however, if said curb cut is the result of a driveway installation that is subject to the provisions of Section 909.01, then, in that event, this section shall not apply.
   (b)   Application.  An applicant for a curb-cut permit shall file with the Village Zoning Inspectoran application showing:
      (1)   Name and address of the owner, or agent in charge of the property abutting the proposed work area;
      (2)   Name and address of the party doing the work;
      (3)   Location of the work area;
      (4)   Attached plans showing details of the proposed alteration;
      (5)   Estimate cost of the alteration;
      (6)   Such other information and specifications including driveway apron specifications as the Consulting Engineer of the Village, after approval by Council deem necessary.
      (7)   The employment of either concrete or asphalt for the driveway apron in accordance with the specifications for materials and methods of installation on file with the Consulting Engineer of the Village.
   (c)   Fees.  An application for a curb-cut permit shall be accompanied by a filing fee of fifteen dollars ($15.00).
   (d)   Standards.  The Zoning Inspector shall issue a permit hereunder if he finds:
      (1)   The work shall be done according to the standard specifications of the Village.
      (2)   The operation will not unreasonably interfere with vehicular and pedestrian traffic, the demand and necessity for parking spaces, and the means of egress to and from the property affected and adjacent properties.
      (3)   That the health, welfare and safety of the public will not be unreasonably impaired.
      (4)   Any driveway apron to be constructed shall utilize concrete or asphalt.
   (e)   Inspection.  All inspection of work shall be made by the Village Zoning Inspector.
   (f)   Penalty.  Whoever fails to comply with the terms of this section is guilty of a minor misdemeanor.
