311.04  TRAFFIC CONTROL AT WORK SITES.
   (a)   All persons, working within the Village where their work, in the opinion of the Chief of Police or Mayor, affects the movement of traffic, shall post a flagman at such person's expense, at the work site at all times work is being performed.  If, in the opinion of the Chief of Police or Mayor, more than one flagman is required, then such additionally required flagman or flagmen shall be posted at the subject work site at the person's expense.
   (b)   Any person anticipating the performance of work within the Village that may affect the movement of traffic shall notify, in writing, the Chief of Police and the Mayor, not less than forty-eight hours in advance of the commencement of such work, of the work planned.  Such notification shall include the description of the work site, the work to be performed, the estimated time of commencement and completion, and other information as the Chief of Police or Mayor shall reasonably request.
   (c)   If, in the judgment of the Chief of Police or Mayor, a work site requires, for the safety of the public, the immediate placing of personnel to maintain flag positions until proper personnel are supplied by the person performing the subject work, the Chief of Police or Mayor may cause Village personnel to maintain such positions until proper personnel are supplied by the person performing such work or until the project is completed; or, the Chief of Police or Mayor may, at their sole discretion, cause the work sites to be immediately closed and all work to immediately cease.  In the event that it is essential for Village personnel to maintain such flag positions, the person performing the subject work shall be responsible for the cost of posting the Village personnel.
   (d)   Any person who is found to have violated any of the provisions of this section shall be subject to having all work stopped in addition to being guilty of a minor misdemeanor on the first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, such person is guilty of a misdemeanor of the third degree.
