(a) Four (4) sets of the Erosion and Sediment Control Plan ("ESC Plan") and necessary data required by this chapter shall be submitted to the Community Engineer as follows:
(1) For subdivisions: After the approval of the preliminary plans and prior to the approval of improvement plans or drawings by the Community Planning Commission.
(2) For other construction projects: Concurrently with the submittal of construction drawings to the Community Engineer.
(3) For general clearing projects: Thirty (30) working days prior to any soil disturbing activities.
(b) The Community Engineer shall review the ESC Plan and approve, or return for revisions with comments and recommendations for revisions, within twenty-one (21) working days after receipt of the ESC Plan as described above. An ESC Plan rejected because of deficiencies shall receive a narrative report stating specific problems and the procedures for filing a revised ESC Plan. At the time of receipt of a revised ESC Plan, another twenty-one (21) day review period shall begin.
(c) Approved ESC Plans shall remain valid for one (1) year from the date of approval. A copy of the approved ESC Plan and its review report shall be forwarded by the Community Engineer to the Lake Soil and Water Conservation District.
