(a) The intent of this chapter is to establish technically feasible and economically reasonable standards to achieve a level of erosion and sediment control that will minimize damage to property and degradation of water resources, and will promote and maintain the health and safety of the citizens of North Perry Village.
(b) This chapter will:
(1) Allow development while minimizing increases in downstream flooding, erosion, and sedimentation.
(2) Reduce damage to receiving water resources and drainage systems that may be caused by increases in the quantity and/or rate of water discharged from new development activities or redevelopment activities.
(3) Reduce deterioration of the receiving waters.
(c) This chapter applies to, and requires an Erosion and Sediment Control Plan from, soil-disturbing activities on land used or being developed, either wholly or partially, for non-farm residential, commercial, industrial, or other non-farm purposes including, but not limited to, those listed below:
(1) Highways, underground cables, and pipelines.
(2) Development on one (1) or more acres of land or on less than one (1) acre of land if part of a larger common plan of development on one (1) or more acres of land.
(d) This chapter applies to, but does not require an Erosion and Sediment Control Plan from, development areas on less than one (1) acre of land that is not part of a larger common plan of development on one (1) or more acres of land. These minimal areas shall be developed in accordance with all other provisions of this regulation.
