10-13-2: PERMITS:
It shall be unlawful to establish any use of a building, structure, or land, either by itself or in addition to another use, or to erect a new building or structure or part thereof, or to rebuild, structurally alter, add to or relocate any building or structure, or part thereof, or to demolish any building or structure or part thereof, without obtaining a permit from the Zoning Enforcement Officer in accordance with the following regulations:
Unless otherwise specifically provided in this title, violations of any provision of this title, shall be punishable by a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00). Each day that a violation is continued or permitted to continue shall constitute a separate offense, and shall be punishable as such. 
   (A)   Permits:
      1.   Contents Of Application: Application for permits shall be filed in written form with the Enforcement Officer, shall state the legal description of the property, the name and address of the owner, the applicant, and the contractor, the estimated costs, and shall describe the uses to be established or expanded, or indicate why demolition is required and shall give such information as may be required by this title for its proper enforcement.
      2.   Drawing: All applications for a building permit shall be accompanied by a dimensioned drawing of the building plot showing the location of buildings and structures, lot areas to be used, and auto parking areas.
      3.   Accessory Structures: Each permit issued for a main building shall also cover any accessory structures or buildings to be constructed or demolished at the same time on the same premises, and such permit shall be posted in plain sight on the premises for which it is issued, until completion of construction or demolition.
      4.   Documents To Be Filed: All applications and a copy of all permits issued shall be systematically filed and kept by the Village Clerk for ready reference.
      5.   Permit Fees: To partially defray the expenses for reviewing the plans of said property, the following fees shall be charged by the Village at the time a permit is issued:
(a)
Single family dwelling, with or without attached garage 
$150.00 first 1,200 square feet, excluding basement, $10.00 per 100 square feet, or fraction thereof, thereafter 
(b)
Two family dwelling 
$300.00 first 2,000 square feet, excluding basement, $10.00 per 100 square feet, or fraction thereof, thereafter 
(c)
Multiple family dwelling 
$200.00 per unit for first 700 square feet, $10.00 per 100 square feet, or fraction thereof, thereafter 
(d)
Residential addition or alteration (for categories in subsections (A)5(a), (A)5(b), and (A)5(c) of this section) 
$50.00 per first 500 square feet, $10.00 per 100 square feet, or fraction thereof, thereafter 
(e)
Construction of detached Class 1 garage or accessory building 
$100.00 first 750 square feet, $10.00 per 100 square feet, or fraction thereof, thereafter 
(f)
Move any building or structure

(g)
For a new principal structure for commercial, church or not-for-profit use

For a construction permit to construct a driveway only in the Village. (This permit is not required if one of the above permits has been issued for the current project.)

      Individuals applying for a permit will make application at the Village Hall. A ten dollar ($10.00) processing fee will be charged at that time. Subsequently, the Zoning Enforcement Officer will review the application and the proposed construction or demolition site. Upon approval of the application, a permit will be issued. Payment of the permit fee may be made by the applicant either at the Village Hall or to the Zoning Enforcement Officer, who shall remit said fee to the Village on a regular basis. No refund of the processing fee or permit fee will be made.
      Building permits issued for work in Village residential districts shall be valid for twelve (12) months from the date issued. If the structure is not completed within that time, a new permit, which will add six (6) months to the completion date, will be required at a cost of one and one-half (11/2) times of the original permit fee. Noncompletion of the structure by the end of the six (6) month extension may result in a stop work order being issued and/or review by the Village Board and Village Attorney for possible legal action.
   Permits issued for work in Village business, commercial or industrial districts shall be valid for eighteen (18) months from the date issued. At that time, a new permit, extending the completion date by twelve (12) months, may be issued at one and one-half (11/2) times of the original permit fee. Noncompletion of the structure by the end of the twelve (12) month extension may result in review by the Village Board and Village Attorney for possible legal action.
      A demolition permit shall be valid for six (6) months from the date issued. If the demolition is not completed within that time, a new permit, valid for an additional six (6) months will be required at a cost of two (2) times the original permit fee. Noncompletion of demolition within the twelve (12) months of the original permit will be subject to review by the Village Board and Village Attorney for possible legal action.
      A permit may be revoked under the following circumstances:
         (a)   If any work or change in use authorized by the permit has not substantially begun within ninety (90) days of issuance; or
         (b)   If the Zoning Enforcement Officer finds by his personal observation or from competent evidence that the rules and regulations under which it has been issued have been violated.
      Any work on-site subsequent to such revocation shall require that a new permit be applied for and issued at one and one-half (11/2) times the original permit fee. The new permit will be subject to the same time to complete requirements and penalties for noncompliance as any other new permit.
      6.   Size: A building permit shall be required for any proposed structure, either temporarily or permanently affixed, with greater than one hundred forty four (144) square feet of floor area.
      7.   Replacement: Subsection (A)5 of this section is hereby declared to supersede and replace any conflicting provisions contained in the 2006 International Building Code which has been incorporated in title 4, chapter 1, of this Code heretofore adopted.
      8.   Stop Work Orders: To defray additional cost of administering "stop work" orders posted by the Zoning Enforcement Officer as a result of construction or demolition without the appropriate permit as required herein, or construction or demolition contrary to the authority of the permit, there shall be an additional charge of one hundred dollars ($100.00). If the stop work order is placed on construction outside the authority of the permit and it is found that the Village was at fault on the authority of the permit, then the one hundred dollars ($100.00) charged shall be refunded.
