10-2-6: GENERAL REGULATIONS:
Except as hereinafter provided:
   (A)   Permitted Purpose: No building shall be erected, converted, enlarged, reconstructed or structurally altered, nor shall any building or land be used except for the purpose permitted in the district in which the building or land is located.
   (B)   Building Height: No building shall be erected, converted, enlarged, reconstructed or structurally altered to exceed the height limit herein established for the district in which the building is located.
   (C)   Conformance: No building shall be erected, converted, enlarged, reconstructed or structurally altered except in conformity with the area regulations of the district in which the building is located.
   (D)   Yards And Open Spaces: The minimum yards and other open spaces, including lot area per family, required by this title for each and every building existing at the time of the passage hereof, or for any building hereafter erected shall not be encroached upon or considered as yard or open space requirements for any other building.
   (E)   Lots: Every building hereafter erected or structurally altered shall be located on a "lot" as herein defined and in no case shall there be more than one main building on one lot unless otherwise provided in this title.
   (F)   Front Yard: The front yard requirements of both streets of a corner lot shall be observed for all buildings and structures, including accessory buildings.
   (G)   Garages and Outbuildings Height: All garages and outbuildings shall not exceed eighteen feet (18') in height above the main floor level unless said structure is an integral part of the main building, in which case the height shall not exceed the height of the main building.
   (H)   Easements: Any property over which the village has an easement for street or roadway purposes or utilities and all adjoining property shall be subject to the restrictions and setback requirements of this code the same as if said easement was already an existing dedicated village road or street, however, said property over which the village has a roadway or street easement shall remain in the control and use of the private property owner subject to the above restrictions, unless and until the village takes possession of said property by dedicating same as a public roadway or public street in the village.    (I)   Traditional Theme: It is hereby declared that a traditional theme is hereby set for the construction and decorating in the village of North Pekin. All building materials used in the construction and/or exterior decoration of any building must be traditional materials such as brick, stone, stucco, wood, glass, or materials which attempt to replicate brick, stone, stucco, wood, or glass. Nontraditional building materials such as cans, bottles, materials used in the construction of automobiles, trucks, motorcycles, aircraft or boats may not be used in the construction of or decoration of the exterior of any building constructed in the village of North Pekin, Illinois.    (J)   Application And Review Procedure For Subdividing: The application and review procedure for subdividing any property within the village of North Pekin, Illinois, shall be as follows:
      1.   An application to subdivide a property may only be initiated by the fee owners of the property, or his designated agent.
      2.   The planning and zoning commission shall conduct the application and hearing process for all requests to subdivide any property.
      3.   A nonrefundable initial application fee of one hundred fifty dollars ($150.00) shall be charged for all applications to subdivide a property.
      4.   Along with submitting the application form, applicants for subdividing a property, must also produce site plans depicting the general layout of the parcel, a survey and legal description of the property (where requested by the planning and zoning commission), and a letter stating the proposed use for the parcel(s), the approximate gross floor area of existing or intended buildings or structures, a statement that the applicable standards to the specific use have and will continue to be met.
      5.   The planning and zoning commission shall study the application, make relevant inquiry and conduct a publicly noticed hearing with regard to the subdividing of the property in which they shall hear any evidence or statement presented by the applicant or his representative or by other persons attending the hearing, as well as consider any other written or oral statements or evidence as they, in their sole discretion, deem relevant. The planning and zoning commission shall make a written report of their findings, including any recommended conditions of subdividing the property, if any, to the board of trustees of the village of North Pekin, within sixty (60) days after acceptance of the completed application.
      6.   The board of trustees shall review the written report and recommendations of the planning and zoning commission toward subdividing the property, and any recommended conditions. If the planning and zoning commission recommends against subdividing the property, the property can only be subdivided if the village board votes for the same to be subdivided by an affirmative majority vote of the elected members of the village board of trustees. The village board of trustees shall grant or deny the application to subdivide property within sixty (60) days of receipt of the written report of the planning and zoning commission.  (Ord. 1040, 8-10-2020)
