(a) Parking tickets shall be written on a pre-printed form approved by the Chief of Police, which shall include all information necessary to identify the motor vehicle in violation and its registered owner. Upon observation of a parking violation, parking tickets may be issued by any police officer or auxiliary police officer specifically designated by the Chief of Police, and shall then be securely placed upon the vehicle parked in violation of this chapter, specifically by placing a copy of the parking ticket beneath the windshield wiper on the driver’s side of the vehicle. The registered owner of a motor vehicle ticketed for a parking violation shall appear at the North Olmsted Police Department to pay the fine for such parking violation, in person, through a designated representative, or postmarked by mail, within forty-eight hours after the issuance of such parking ticket, Sundays or holidays excepted, and pay a fine of fifteen dollars ($15.00), without costs. If such payment is tendered or postmarked more than forty-eight hours after such issuance, Sundays or holidays excepted, then the fine shall be increased to twenty-five dollars ($25.00), without costs. Voluntary payment of such fine shall not be deemed a formal admission of guilt but shall constitute acknowledgment of the validity of the parking ticket and shall preclude the prosecution of the misdemeanor offense alleged therein.
(b) Notwithstanding other fees contained herein, any violator of Section 351.20(b)(1) shall pay a fine of fifty dollars ($50.00) without costs.
(c) Unless a different penalty is expressly provided for in another section of this chapter, whoever violates any provision of this chapter shall be guilty of a misdemeanor. If a parking ticket is not paid within a seventy-two hour period pursuant to the procedure provided in paragraph (a), then the Police Department shall issue at least one (1) written communication to the registered owner of the motor vehicle that was issued the parking ticket, at the address of registration on record with the Bureau of Motor Vehicles, and therein advise the registered owner of the unpaid parking ticket. Such written communication shall be forwarded by regular mail and shall further advise that any unpaid parking ticket will be forwarded to the Rocky River Municipal Court or the City of North Olmsted Mayor’s Court, by a date specific, not less than ten (10) days from the date of such correspondence, for further proceedings and prosecution of the parking violation, subject to the imposition of Court costs. Unpaid parking violations may then proceed to Rocky River Municipal Court or the City of North Olmsted Mayor’s Court upon the issuance of a uniform traffic citation and subject to all procedures therein. Such parking violations thereafter shall be subject to the penalties provided in this chapter, or if no specific penalty is provided for a section of this chapter, then in accordance with Section 303.99.
