(a) No person, except the carrier, employees of the carrier, representatives of the shipper when their presence is necessary for the safe care of livestock, representatives of the Public Utilities Commission of Ohio or public officials in the proper performance of their duties, shall be transported upon any motor vehicle transporting property. However, each person permitted by this section to be transported upon such motor vehicle, except those engaged in the actual operation of the motor vehicle, shall have printed or written authority therefor from the carrier. This rule does not prohibit the carrying of any person in case of an accident or in other extreme emergency.
(b) Except in case of emergency, no driver shall permit a motor vehicle to which he is assigned to be driven by any person not authorized to drive such vehicle by the motor carrier in control thereof.
(c) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
