177.03 APPLICATIONS; REVIEW BY MAYOR’S DESIGNEE.
   (a)   Community organizations desiring to announce community events through the City media or wishing to link to the City's website, shall make an application to the City in writing, on a form prepared by the City. The Mayor or his designee shall be the City official responsible for:
      (1)   Receiving and acting upon applications for access to the nonpublic forums;
      (2)   With respect to the banners and changeable copy signs, determining the maximum number of space, in characters, available for messages; and
      (3)   Authorizing written opinions whenever an application is denied; explaining the grounds for denial.
   The Mayor shall designate a member of his staff to review and act upon applications made pursuant to this chapter.
   (b)   Applications must be completed and signed no later than thirty (30) days prior to the time the applicant requests that the announcement be made.
   (c)   Applications shall contain all information requested by the form adopted by the City, including but not limited to the name and address of the community organization representative responsible for submitting the application and supplying any additional information necessary to the processing of the application. Additionally, the applications for signs and banners shall include the date the announcement is requested.
   (d)   Applications must conform to the regulations of this chapter in all particularities. If the Mayor's designee, upon review of the application, discovers any irregularity or defect therein, the application shall be denied for failure to conform to these regulations.
   (e)   Applications shall be acted upon by the Mayor's designee, in writing, within ten working days following the date of filing of the application. Applications shall be routinely granted, and may not be denied by the Mayor's designee, unless the application, or the proposed announcement, fails to conform to at least one express provisions of this chapter. Decisions denying an application shall be mailed to the applicant by certified mail, return receipt requested. No application shall be denied unless the reason for denial has first been reviewed by the Director of Law. (Ord. 2010-105. Passed 9-21-10.)
