(a) There are hereby established three distinct classifications relating to the collection of refuse which shall be designated as follows:
(1) Single-family residential structures;
(2) Multi-family residential structures; and
(3) Commercial structures.
(b) The classifications as indicated in subsection (a) hereof shall be defined as follows:
(1) Single-family residential structures. All residential structures used and maintained exclusively as single-family residences which shall include single-family and two-family structures and two-story attached condominium structures.
(2) Multi-family residential structures. All residential structures used and maintained exclusively as condominiums in excess of two stories.
(3) Commercial structures. All structures kept and maintained in total or in part for the carrying on of commerce either wholesale or retail, which shall include all structures kept and maintained in accordance with the uses permitted by the zoning classifications of local retail, general retail and limited industry as well as office buildings.
(c) The City will provide refuse pick-up service for single-family residential structures and multi-family residential structures (collectively "Residential Structures") that are in compliance with the provisions of Chapter 941, in accordance with the following regulations:
(1) Residential Structures. The City will provide refuse pick-up service for residential structures located on dedicated streets in the City in accordance with schedules and regulations adopted by the Department of Public Service. All refuse shall be placed in containers acceptable to the Director of Public Service. Such containers shall be placed along the dedicated right of way or right of way to be dedicated in the future, prior to the time of scheduled collection.
(2) Commercial and Other Structures. The City will not provide refuse pick-up service for commercial structures establishments as defined herein, churches, schools, apartment structures, boarding houses, hotels and motels.
(d) Although the City does not provide refuse pick-up service for residential structures located on non-dedicated streets, the City, with approval of Council, may enter into an agreement with the owners of residential structures on non-dedicated streets, or, if applicable Home Owner’s Associations representing owners of residential structures on non-dedicated streets, to contribute to an agreed upon cost for refuse pick-up service for such residential structures when said residential structures are otherwise in compliance with the provisions of Chapter 941 as it regulates “residential structures” on dedicated streets.
