There is hereby established a total fee of one thousand dollars ($1,000) per parcel of land which shall be paid by any benefiting property owner who petitions Council pursuant to Ohio R.C. Chapter 723. Such fee shall be paid by the benefiting property owner at the time that the petition for vacation is presented to Council. In the event that Council fails to approve the vacation of the roadway, then eight hundred dollars ($800.00) of the one thousand dollars ($1,000) deposited with the City shall be returned to the applicant.
