(a) As used in this section, the term:
(1) “Laser” means a maser that can generate or amplify light waves.
(2) “Laser pointer” means a compact instrument consisting of a low-power, visible light laser, designed to be used primarily for pointing out features on a projected visual display.
(3) “Maser” means any of various devices that generate electromagnetic waves of precise frequency or that amplify such waves while maintaining frequency and phase by using the excess energy of a resonant atomic or molecular system.
(b) It shall be unlawful for any person to focus, point or shine a laser beam directly or indirectly on another person or animal in such a manner as to harass, annoy, or injure said person or animal.
(c) It shall be unlawful for any person under the age of eighteen years to possess a laser pointer. A person shall not be in violation of this section if his possession of a laser pointer is necessary for his employment, trade, or occupation and it is necessary for the pointer to be carried on his person. Further, a person shall not be in violation of this section if, at the time if his possession, he is acting under the immediate supervision of a teacher or parent.
(d) It shall be unlawful for any person to sell, or offer for sale, a laser pointer to any person who, at the time, is under the age of eighteen years.
(e) Any person who violates paragraphs (b), (c) or (d) of this section is guilty of a minor misdemeanor. (Ord. 99-50. Passed 5-18-99.)
