509.08 MINORS' CURFEW.
   (a)   No minor under the age of sixteen years shall congregate, wander, loiter or play upon the streets, sidewalks, public places, places of amusement and entertainment, or on unenclosed lands within the Municipality between the hours of 11:00 p.m. and 5:00 a.m. the following day, unless accompanied by a parent, guardian or a responsible person over twenty-one years of age, or a member of his family eighteen years of age or older.
   (b)   No minor sixteen to eighteen years of age shall congregate, wander, loiter or play upon the streets, sidewalks, public places, places of amusement and entertainment, or on unenclosed lands within the Municipality between the hours of 12:00 midnight and 5:00 a.m. the following day, unless accompanied by a parent, guardian or a responsible person over twenty-one years of age or a member of his family over eighteen years of age.
   (c)   No person having the control and custody of, or being the parent or guardian of a minor under the age of sixteen years shall permit such minor to congregate, wander, loiter or play upon the streets, sidewalks, public places, places of amusement and entertainment, or on unenclosed lands within the Municipality between the hours of 11:00 p.m. and 5:00 a.m. the following day, unless accompanied by a parent, guardian or a responsible person over twenty-one years of age, or by a member of his family eighteen years of age or older.
   (d)   No person having control and custody of, or being the parent or guardian of a minor sixteen to eighteen years of age, shall permit such minor to congregate, wander, loiter or play upon the streets, sidewalks, public places, places of amusement and entertainment, or on unenclosed lands within the Municipality between the hours of 12:00 midnight and 5:00 a.m. the following day, unless accompanied by a parent, guardian or a responsible person over twenty-one years of age, or by a member of his family eighteen years of age or older.
   (e)   This restriction shall not apply to minors on an emergency errand or on legitimate business such as the delivery of newspapers, or on legitimate business as directed by the parent, guardian or custodian of such minor, or by a person who has been given responsibility for a minor's control and custody by the person who is legally responsible for the control and discipline of such minor.
   (f)   In the event that any school, church, lodge or other organization within the Municipality sponsors a function attended by minors within the age limitations set forth herein and minors will be dismissed from such functions at an hour later than herein provided, such school, church, lodge or other organization shall first obtain the Mayor's approval to have minors remain to the time when the entertainment or function will end. Minors attending such functions or entertainment shall be required to be at home and off the streets, sidewalks, public places, places of amusement and entertainment, or unenclosed lands within the Municipality within one hour after such entertainment or function has ended.

   (g)   Whoever violates this section is guilty of a minor misdemeanor.
