§ 90.142 RECOVERING COST.
   The city may, without notice to any person, remove the litter, snow, ice, or other debris from the public property, keeping an accurate account of the cost. The cost shall be recovered utilizing either of the following methods:
   (A)   If the person violating this section is the owner or occupant of abutting private property, then the cost shall be assessed to such owners property, in conformance with the provisions of this chapter;
   (B)   As an alternative to the assessment procedure or if the person violating this section is not the owner or occupant of abutting private property, then the City Attorney, upon direction of the Council, shall bring suit in District Court to recover from such violator such cost, including costs, disbursements and actual attorneys fees in bringing the action.
