§ 90.080 NUISANCE ABATEMENT.
   In abating the nuisances defined in this subchapter, the Inspector shall cause the infected tree or wood to be sprayed, removed, burned, or otherwise effectively treated so as to destroy and prevent as fully as possible the spread of shade tree disease. Such abatement procedures shall be carried out in accordance with current technical and expert opinions and plans as may be designated by the Commissioner of the Minnesota Department of Agriculture. No damage shall be awarded the owner for the destruction of any shade tree, tree wood, or tree material. The cost of the abatement action shall be assessed against the private property in accordance with the provisions of this chapter.
